摘要/Abstract

摘要： 随着新一代信息技术的迅速发展和逐渐渗透到各行各业,个人信息保护开始与大数据发生紧密关联,并被赋予了新的时代意义。个人信息保护成为数字贸易规则议题中的重要一支,主要聚焦于基础性概念的再定义、数据的使用与共享问题以及背后更深入的权利原则。回顾了国内外个人信息保护议题的概念困境和理论研究,分析了当前欧盟、美国、日本对待个人信息保护议题的立场分歧和政策举措,并对我国关于个人信息保护的法律制定、执法规范和对外主张进行解读,为我国今后完善个人信息保护法律法规和政策举措以及应对数字贸易规则谈判提供依据和建议。

Abstract: With the rapid development of a new generation of information technology and its gradual penetration into all walks of life, personal information protection has begun to be closely associated with big data, and has been given a new meaning in digital era. The protection of personal information has become an important issue in the digital trade rules, focusing on the redefinition of basic concepts, the use and sharing of data, and the principles of rights behind it. This paper reviews the conceptual dilemma and theoretical research on personal information protection issues at home and abroad, analyzes the current differences and policy measures of the European Union, the United States, and Japan on personal information protection. Interpretation of external claims will provide basis and suggestions for China's future improvement of personal information protection laws, regulations and policy measures, as well as negotiations on digital trade rules.
