Abstract:

The realization of the “dual carbon” goals has put forward higher requirements for carbon emission control. At present, carbon emission governance is confronted with practical challenges such as questioning the necessity of legislation, chaotic law enforcement, and difficulties in judicial application. From the perspective of multi-dimensional rule of law, the two dimensions of public law and private law provide a research basis for the legal synergy of carbon emission governance. On the one hand, the application of public laws is indispensable for the governance of carbon emissions in our country. On the other hand, enterprises should be regulated by relevant private law norms during their production and operation, carbon emission rights trading with other enterprises, and the disclosure of carbon emission information. To this end, the realization of the rule of law for carbon emissions should establish an overall collaborative path featuring the coordination of public and private laws, as well as the coordination of laws, policies and technologies.
