    • From the perspective of feedback system, this paper introduces the concept of “entropy”, which describes the degree of system order, into the construction and evaluation of smart cities, and constructs its system framework model. Through the system dynamics modeling method, the smart city is modeled, which is abstracted as the data collection, transmission and application system, and is quantitatively described in combination with the new smart city evaluation criteria. By modeling and analyzing the smart city evaluation data of a city, the feasibility and effectiveness of the model method are verified.

    • Abstract ( 622 ) HTML( 254 )
    • The wide application of Internet of Things technology has strongly promoted the construction of smart cities. By settling the common needs of urban governance, building a digital city perception base that supports ubiquitous device access, data storage analysis, reverse control and other general capabilities can better integrate the upper layer Internet of Things applications and accelerate the urban digital transformation. In terms of device access, this paper proposes a new data model and device physical model based on device characteristics, and constructs a storage system of distributed Internet of Things platform based on the data model and device physical model. In terms of device control, it supports cloud control and local control. Based on the digital city perception base proposed in this paper, smart city applications such as smart epidemic prevention, smart water conservancy and smart fire protection are constructed, effectively promoting the urban digital transformation.

    • Analysis on the trend of local legislation related to data —take Shenzhen and Shanghai as examples
    • CHEN Tian
    • Information and Communications Technology and Policy. 2022, 48(12): 63-67. DOI:10.12267/j.issn.2096-5931.2022.12.010
    • Abstract ( 251 ) HTML( 154 )
    • After 2020, the construction and cultivation of data element market has become the main task of data related local legislation. The data regulations issued by Shenzhen and Shanghai are particularly significant in this regard. The advanced exploration of local legislation is beneficial to guide the construction of data element market system, respond to the needs of economic development and promote future national legislation. However, it is necessary to solve key problems such as how to understand and locate the property attribute of data, how to allocate benefits of data access and income, and how to protect personal information. The EU's legislative ideas on data access rights are worthy of our reference. The next important work is the after-legislation evaluation, to summarize experience in time, and to ensure the legal system can always promote the development of digital economy.

    • 2022 Anti-Monopoly Law of the PRC’s responses to and prospects of the platform economy
    • HAN Wei
    • Information and Communications Technology and Policy. 2022, 48(12): 68-72. DOI:10.12267/j.issn.2096-5931.2022.12.011
    • Abstract ( 256 ) HTML( 151 )
    • The 2022 amendment to the Anti-Monopoly Law of the PRC (AML) makes minor modifications to the 2008 AML, in response to challenges raised by the platform economy. Through introducing a new article (Article 9) to the General Chapter and revising previous article against abuse of dominant market position (Article 22(2)), the 2022 AML provides explicit legal basis for the Chinese competition authority to directly respond to the platform economy. Articles on the new legislative purpose (“encouragement of innovation”), hub-and-spoke arrangement, review of mergers having not met the notification threshold, and the classification and grade mechanism in relation to merger control are indirect responses to the platform economy. To more efficiently and effectively implement the 2022 AML, Chinese competition authority should improve supporting guidelines and regulations, especially cautious application of technical concepts, to guarantee a good match between anti-monopoly regime and the development of platform economy. Positive roles played by capitals should be respected when controlling the expansion of capitals through merger control and other anti-monopoly tools. To better coordinate the relationship between anti-monopoly rules, and data protection, consumer right and interest protection rules, China should think twice before introducing provisions against exploitative abuse of dominance.
