Abstract: In the fight against COVID-19,processing of big data is of great use in the dealing of the emergency, which also forth the question of how to rebalance the data process and personal data protection. Although the administrative branch is entitled with a broad power of collecting and analyzing information,there exists still incompetence in the relevant rules. The data process and personal data protection should be rebalanced under the emergency of epidemic situation with specific and detailed rules.
