Abstract: With the continuous development of the technology in big data, informed consent framework, as a basic principle in the field of personal information protection, has some practical application difficulties, such as serious formalism, vague terms, lack of feedback of diversified opinions, etc. , which will be difficult to restrict the personal information collection and processing behavior of enterprises. This paper analyzes the reasons for the application dilemma of informed consent framework from three aspects of user factor, enterprise factor and objective factor, and summarizes the fundamental reason as that users and enterprises are in the unequal position of information. In order to reduce the information gap between users and enterprises and increase users’ control over collection and processing of personal information, this paper analyzes the improvement of the framework of informed consent from the perspectives of improving legal regulations, strengthening supervision and inspection, etc.
